I, the undersigned, as tenant, hereby solemnly affirm and agree as follows, including Schedule- A:
- I shall furnish all requisite documents, including a government-issued photo identification (e.g., National ID, Passport, or Driving License). Failure to provide such documentation, or submission of false information, shall result in the immediate nullification of my reservation.
- If a guest is present to accompany me, it is my responsibility to provide their identification as above.
- I acknowledge and accept that visitors are prohibited from entering the apartment.
- I understand and concur that cohabitation by unmarried couples and the commission of any acts deemed immoral on the premises are strictly forbidden.
- I shall adhere to all regulations and avoid causing disturbances to both the authorities and residents.
- I am required to declare the purpose of my stay, supported by relevant documentation. I acknowledge that the authorities retain absolute discretion in approving or denying my reservation.
- I shall conduct myself respectfully towards all building staff and comply with the building’s rules and regulations. Any misconduct by me will not be tolerated.
- I shall be solely responsible for any illegal, unlawful, or criminal activities committed by me within the apartment during my occupancy. The authority of REIT LIMITED will not be responsible for any criminal act or omission done by me in any manner.
- I agree to bear the cost of electricity consumed during my stay and to remit the reservation fee in advance, in accordance with the established policy.
- The contact number I have provided in the Police Verification Form will be subject to verification.
- I affirm not to damage or tamper with any property belonging to the authorities.
- I acknowledge and agree that my check-in time is 2:00 PM and my check-out time is 11:00 AM. I agree to bear the costs of any additional services required by me during my stay, which are not included in the initial offer. Furthermore, I shall compensate REIT Limited for any damage caused during my occupancy.
- If I require any additional services during my stay that were not initially included in the offer, I hereby agree to pay for them. Additionally, I will provide compensation for any damage that may have occurred during my stay.
I hereby solemnly affirm that the information provided herein is accurate, and I voluntarily accept and agree to abide by these conditions in whole.
TENANCY STATUTORY TERMS AND CONDITIONS
- The Demised Premises shall accommodate not more than __________ person(s) as tenants.
- Engaging in immoral, unlawful, or any criminal activities on the premises is expressly forbidden for the duration of the tenancy.
- The Tenant shall bear full responsibility for any damage incurred and is obligated to restore the premises to a “broom-clean” state upon the termination of tenancy.
- The Tenant assumes full liability for any illegal, unlawful, or criminal activities committed by him within the apartment throughout the duration of the tenancy.
- The Landlord/REIT Limited retains the right to terminate the tenancy agreement or seek damages for non-payment of electricity or utility bills by the Tenant.
- Non-adherence to the Check-In and Check-Out schedule will incur additional daily charges.
- The presence of pets, animals, and the use or storage of alcohol (chemical or consumable) on the property is strictly prohibited.
- The Landlord/REIT Limited or their designated person reserves the right to inspect the property bi-weekly, with or without prior notice to the Tenant.
- Visitors are required to vacate the premises by 11:00 pm nightly.
- Breach of the building’s clauses, terms, or rules by the Tenant empowers the Landlord/REIT Limited to revoke the tenancy agreement and initiate eviction.
- Activities causing disturbance, including loud noise, music, drug use, or domestic violence, are strictly prohibited.
- In accordance with SCHEDULE A of the leased apartment, I, the tenant, am bound to return in the original condition all items as specified in the schedule of furniture, equipment, and amenities prior to the expiration of the Tenancy Agreement.
- Payments that are more than three days past due will incur a late fee of BDT 4,000.00 per day, commencing on the day after the due date.
- During the tenancy, the UNDERSIGNED TENANT shall be held liable for any property damage that occurs and shall pay the complete expense of any necessary repairs or restorations.
- Subletting and Assignment: The UNDERSIGNED TENANT shall not sublet, assign, or transfer any part of the Premises or this Tenancy agreement without the prior written consent of the Landlord/REIT Limited.
- Alterations and Improvements: No alterations, additions, or improvements shall be made by the Tenant to the Premises without first obtaining the Landlord’s/REIT Limited’s written consent. Any authorized alterations shall become part of the Premises and owned by the Landlord.
- Default and Remedies: In the event of a Tenant’s default, the Landlord is entitled to exercise remedies including termination of tenancy, reclaiming possession of the Premises, and seeking damages.
- Compliance with Laws and Regulations: The UNDERSIGNED TENANT must agree to comply with all local, state, and national laws and regulations, including but not limited to health and safety standards applicable to the Premises.
- Early Termination Clause: Either party may terminate this tenancy agreement early under conditions specified herein, subject to an early termination fee and notice period.
- Renewal Terms: Upon the expiration of the tenancy period, the Tenant may opt to renew the tenancy agreement under terms to be mutually agreed upon, including potential rent adjustments, subject to a written renewal agreement.
- In the event of a natural disaster or a significant event rendering the Premises uninhabitable, either party shall have the right to terminate this Tenancy Agreement. This right may be exercised if the Premises remain uninhabitable for a period exceeding 30 days following the occurrence of such an event. Termination under this provision shall be executed in writing, with both parties’ rights and liabilities being governed by the terms outlined in this agreement.
- Access Rights of the Landlord/REIT Limited: The Landlord/REIT Limited, or their duly authorized representative, reserves the right to enter the Premises for purposes of inspection, maintenance, or showing to prospective tenants. This entry may occur without liability for the supervision or care of the Premises. In cases of emergency, such access is permissible without prior consent from the Tenant. Furthermore, during a reasonable time of the period of tenancy, the Landlord/REIT Limited shall be entitled to display ‘To Let’ signage and conduct viewings with prospective tenants. The Premises shall be available for such viewings to upcoming tenants during the last few days of the tenancy period, which may occur with or without prior notice to the Tenant.
- Limitation of Liability: I hereby acknowledge and affirm that Landlord/REIT Limited is NOT legally responsible or liable for any loss of life or property, or for any physical injuries resulting from structural damage, electrical, lift or electronic malfunctions, short circuits, gas leaks, burns, building fires, elevator collapses or any other unforeseen extraordinary events.
- Indemnification: The TENANT agrees to indemnify and hold harmless the Landlord/REIT Limited from any claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to any breach of this Agreement by the Tenant or any act or omission of the Tenant.
- Force Majeure: Neither party shall be liable for any failure to perform its obligations under this Agreement if prevented by acts of God, war, earthquakes, natural disasters, government regulation, disaster, strikes, civil disorder, or other similar causes beyond the party’s control. In the event of a Force Majeure, as defined under the applicable laws of Bangladesh, the affected party shall be relieved from performing its obligations under this Agreement.
- Severability: If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement otherwise remains in full force and effect and enforceable.
- Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the House Rent Control Act, 1991 of Bangladesh and all other applicable laws and regulations. Any disputes arising from this Agreement shall be resolved through arbitration in accordance with the laws of Bangladesh.
- Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous negotiations, discussions or agreements, whether written or oral, between the parties regarding the subject matter contained herein.
